Daryl E. Dayian
Daryl E. Dayian is a principle at the law firm of Carrrara Dayian P.C. Mr. Dayian has been a member of the Bar of the State of Rhode Island since 1993. He is also a member of the Bar of the Commonwealth of Massachusetts [1994] and is admitted to practice before the United States District Court for the District of Rhode Island, as well as the United States Court of Appeals for the First Circuit. He is a member of the Rhode Island Bar Association, as well as a member of the Superior Court Bench/Bar Committee and the Workers’ Compensation Bench/Bar Committee of the Rhode Island Bar Association. He is also a member of the Defense Counsel of Rhode Island, the Defense Research Institute, and the Rhode Island Mediators Association. He is approved by the Rhode Island Superior Court to serve as an arbitrator in matters in the Rhode Island Superior Court under Court Annexed Arbitration. In the past, he has served as Guardian Ad Litem for personal injury matters in the Rhode Island Superior Court, and the Workers' Compensation Court. Mr. Dayian’s undergraduate studies were at The University of Rhode Island and at the University of Essex, Colchester, England. Prior to becoming an attorney, Mr. Dayian was employed in the insurance industry as a claims adjuster in Massachusetts. He received his Juris Doctor degree from The University of New Hampshire School of Law, Concord, NH. Following graduation from law school, Mr. Dayian served in the Rhode Island Court System for one year as a Judicial Law Clerk to the Justices of the Rhode Island Superior, District, and Family Courts, in all phases of civil & criminal litigation, prepared draft decisions, legal memoranda and jury instructions; he worked extensively with Justices on trials, hearings and motion sessions. Mr. Dayian has developed a trial practice with extensive experience handling civil matters in the District & Superior Courts, as well as in Federal Court. He has tried matters regarding negligence claims, automobile cases, liquor liability, and Dram Shop cases, general liability, and construction defects to conclusion before the Court and Juries and prepared complex matters for trial and arbitration and mediation. He has extensive experience in pre-trial discovery matters as well as depositions of fact & expert witnesses. He also has experience handling matters before the Rhode Island Workers’ Compensation Court, from the Pre-Trial, Trial, and appeals. His experience includes stress, sexual harassment, chemical exposure, carpal tunnel, and other occupational disease claims, as well as fraud matters. HIs practice also includes appellate work, arguing matters before the Rhode Island Supreme Court and the Appellate Division of the Rhode Island Workers’ Compensation Court. Mr. Dayian has also litigated cases that span a wide variety of legal theories, including successfully litigating a case before a jury on behalf of a client under the Uniform Commercial Code for breach of warranty of title regarding the sale of a Chevrolet Corvette, as well as successfully prosecuting a breach of contract matter before a jury in the Providence County Superior Court. HIs practice also includes Landlord Tenant matters, and Insurance Subrogation. Mr. Dayian has conducted continuing legal education seminars on the topic of Workers’ Compensation Law. He presents legal seminars to insurance carriers. Mr. Dayian also served as an ombudsman for the Rhode Island Committee for Employer Support of the Guard and Reserve (ESGR) where he mediated National Guard and Reserve employment issues under the Uniformed Service Employment and Reemployment Rights Act (USERRA). He was also a past Board member of the Quonset Davisville Management Corporation and the East Greenwich Cove Management Commission. |
